Managing Committee
The Managing Committee is the elected governing body of a co-operative housing society, responsible for day-to-day administration, financial management, and compliance with the bye-laws and the MCS Act.
What is Managing Committee?
Every co-operative housing society in Maharashtra is managed by a Managing Committee (MC) — a group of elected members who serve as the society's board of directors. The committee signs cheques, approves expenses, hires staff, calls meetings, and represents the society legally.
Under bye-law 112, management of the society's affairs vests entirely in the Committee. The Committee derives its authority from a valid election conducted under Section 73-CB of the MCS Act 1960.
Why it matters
Without a functioning Committee, the society cannot make any binding decisions — not even authorising routine maintenance payments. If the Committee collapses (mass resignation, term expiry, quorum failure), the Registrar can intervene under Section 77A.
Every member dealing with the society — for flat transfer, maintenance disputes, or sub-letting — must do so through the Managing Committee. Its composition, legitimacy, and records matter for every legal transaction involving a flat.
Legal & regulatory context
Bye-law 112 vests management in the Committee. Bye-law 114 prescribes how many members the Committee must have based on society size. Bye-law 115 fixes the five-year term. Office bearers (Chairman, Secretary, Treasurer) are elected from within the Committee at its first meeting under bye-law 125.
Committee decisions must be by resolution recorded in the Minutes Book. Major decisions require a Special Resolution of the General Body, not just the Committee.

Can a non-member be on the Managing Committee?
No. Under Maharashtra Model Bye-Laws, only members (flat owners admitted as society members) can be elected to the Managing Committee. Tenants and associate members cannot contest elections.
What happens if the Managing Committee does not call the AGM?
Failure to call the AGM within six months of the financial year-end is a bye-law violation. The Registrar can call the AGM, or members can petition the Registrar to do so under Section 73 of the MCS Act.
